The Government of a Democracy is suppose to serve the people, and NOT do things the people aren't aware of. The Government should never make it's own entity in the body politic. They are there to serve the people, not become another group in society.

So, Edward Snowden shouldn't be prosecuted for this. It's the Government that is messing up.

Now, there are some logical things that the Government should keep a secret, but that's only for the time being. Like, say Canada got powerful and could take on the USA and threatens to do so. Would the Government tell the people? No. They'd do diplomatic relations first to sort things out but if Canada says no, that's when the people are informed.
